Waupaca man charged with battery

Theodore L. Mitchell Jr., 31, Waupaca, was charged with felony strangulation, misdemeanor battery and disorderly conduct as acts of domestic abuse, and with felony and misdemeanor bail jumping.

Because he was convicted of substantial battery in September 2010 in Winnebago County, Mitchell was charged as a repeat offender.

On Oct. 2, 2013, Mitchell was charged with felony strangulation, misdemeanor battery, disorderly conduct and criminal damage to property as acts of domestic abuse and released on a $2,000 signature bond with the condition that he have no contact with the victim named in the complaint.

On Oct. 7, 2013, Mitchell was charged with 15 counts of contact with victim after domestic abuse arrest. He was released on a $3,000 signature bond with the condition that he not commit any crimes and have no contact with the victim.

On April 28, Waupaca Police Officer Jay Helixon met with Mitchell’s father on the 100 block of North Franklin Street.

His father said he had suspected that Mitchell was making drug deals, so he took Mitchell’s cellphone, busted it and threw it away, according to the criminal complaint.

He accused Mitchell of shoving and kicking him, then jumping on his back and choking him.
He had a video of the incident, the complaint says.

Mitchell told Helixon that his father was intoxicated at the time and had taken his phone and smashed it.
He reportedly said he and his father began wrestling.

Mitchell was released from custody on a $3,000 signature bond with the condition that he have no contact with his father.
