Felony charge follows crash

Michael D. Dayton, 54, Waupaca, was charged with a sixth drunken driving offense and operating after revocation.

At 11:15 p.m. Monday, Aug. 11, Waupaca County Sheriff’s Deputy Chad Repinski was dispatched to a one-vehicle crash on County Road E in rural Waupaca.

When Repinski arrived at the scene of the accident, he found a vehicle that had left the road and collided with a tree.

According to the criminal complaint, the driver was not with the car and the license plates were missing. Repinski reported finding the plates nearby on the ground.

Repinski traced the vehicle to Dayton. He later found Dayton, slightly injured, walking along County E.

Due to his prior drunken driving convictions, Dayton is restricted to a 0.02 blood-alcohol level. A preliminary breath test at the time of his arrest indicated he had a 0.104 blood-alcohol level.
