Kirk L.W. Preuss, 36, Iola, was charged with a fourth drunken driving offense.
At approximately 2 a.m. Aug. 4, 2012, Waupaca Police Sgt. Mario Graceffa observed a car with a defective muffler on West Fulton Street.
Graceffa made a traffic stop and noticed the odor of alcohol when he spoke to the driver, who was identified as Preuss. A subsequent test indicated Preuss had a blood-alcohol level of 0.139.
Preuss was previously convicted of drunken driving offenses in May 2002, June 2010 and Feb. 27, 2015.
He had already been cited for a third offense after his arrest on Aug. 4, 2012. However, after he was convicted on Feb. 27 for a third offense that occurred on July 3, 2013, the 2012 case was refiled as a felony OWI.
