Accused rapist in county jail

 

A former Manawa man is accused of sexually assaultingĀ a woman six days after she had a C-section birth.

Adam R. Van Lyssel, 28, Waukau, is charged with first-degree sexual assault causing great bodily harm, second-degree sexual assault with use of force and third-degree sexual assault.

On the afternoon of Jan. 3, Weyauwega Police Chief Gerald Poltrock and Officer Stephanie Butzer met with a 29-year-old woman who said Van Lyssel assaulted her two times on Dec. 13, 2015.

According to the criminal complaint, the woman said she and Van Lyssel have a child together, and they were celebrating Van Lysselā€™s birthday.

She told the police that Van Lyssel pushed her down on the bed, had sexual intercourse with her and ignored her when she said no.

She told police they had sex again later in the day. She did not fight him in an attempt to get him to leave, the complaint says.

The victim sent Van Lyssel a text three days later, according to court documents.

ā€œYou wouldnā€™t take no for an answer,ā€ the text says. ā€œI didnā€™t want to and I made that very clear but what was I to do Adam, call the cops? Push you? Hit you? You wouldnā€™t stop, so I took the easy way and gave in and let you use me again.ā€

In June 2012, Waupaca County sheriffā€™s deputies investigated a sexual assault that was reported from a hospital. The investigation could not proceed because the woman would not cooperate, the complaint says.

On June 3, 2012, the woman had a cesarean section birth and a tubal ligation. She was medically restricted from having intercourse.
She reportedly told police that when Van Lyssel came to her home to visit their baby, he took the baby from her and forced her to have sex.

Three days later, the woman went to the hospital because she had not stopped bleeding. Police say she suffered ongoing pain and infections and eventually had a hysterectomy.

Charged as a repeat offender, Van Lyssel faces up to 60 years in prison if convicted of first-degree sexual assault.

Van Lyssel was convicted of battery, disorderly conduct and bail jumping and placed on three years of probation in January 2013.

As a condition of his probation, he was prohibited from having contact with the victim, identified as the same woman he allegedly assaulted.

On Feb. 18, Judge Philip Kirk revoked Van Lysselā€™s probation and sentenced him to six months in jail with 50 days credit and work release privileges.

On Feb. 19, Van Lyssel appeared before Judge Vicki Clussman, who set a $25,000 cash bond as a condition of his release. He remains in custody.
