Dayton charged with felony OWI
Michael D. Dayton, 51, Waupaca, was charged with a felony drunken driving offense.
Shortly after 5 p.m. Saturday, Sept. 10, Waupaca Police Officer Lisa Benitez was dispatched to East Side Mobil Express after a witness reported that the driver of a yellow vehicle had thrown a beer can into the trash and drove through the roped-off area of the parking lot.
Benitez traced the license plate number to Dayton and drove to his home on Elm Street.
When she arrived at his home, Benitez reported finding him standing next to the open driver's side door of a yellow vehicle with a pack of beer.
According to the criminal complaint, Dayton told Benitez, "I'm drunk, you know that, the field sobriety test, I'll fail that."
Dayton reportedly had a 0.32 blood-alcohol level at the time of his arrest.
