Tovar charged with sex crimes
Enrique J. Tovar, 20, Waupaca, was charged Nov. 28 with felony sexual assault of a child.
In April 2010, police raided a home on Oak Street in Waupaca after an IP address had been traced to a computer at that home. The IP address had been identified for downloading child pornography.
When police raided the home, they found Tovar living there with another family. There were two daughters in the family and one of them, who was age 15, had a 6-month-old baby. She was 14 at the time the baby was conceived.
Tovar was charged with nine counts of possession of child pornography and two counts of exposing children to harmful material.
A paternity test later confirmed that Tovar was the father of the baby.
He faces up to 40 years in state prison if convicted of sexual assault of a child.

I'm always curious as to why it takes over a year for a serious felony charge to be made.
Why isn't WNOW curious?

That still meets the elements of a crime, albeit a misdemeanor.
Anybody - [i]who thinks that a 17yo male should be having sexual relations with a younger female living in the same household (or that a 16yo mother is different from a 15yo mother)[/i] - is part of the problem.
Nonchalance about such a situation is exactly why they happen in the first place.
In fact, somebody should have been arrested for child neglect, somewhere along the way. That's nonchalance on the DA's part.

Probably the biggest crime these two young people committed was not using contraceptives.

I will agree with you that a 17 year old having sex with a 16 year old doesn't make him a pedophile, but comparing two consenting adults that are both over the age of 18 to two that are not is apples to oranges. As a matter of fact, the female can get charges as well for having sex with a minor that hasn't obtained the age of 18. The law doesn't specify that you have to be 18 or older to have that charged against you.
