Waupaca man charged with giving pot to child

May 2, 2012 | 9 comments

Isaiah Frederick Sommer, 21, was charged with distributing marijuana to a minor near a park, possession of marijuana, possession of a controlled substance and possession of drug paraphernalia.

On April 6, Waupaca Police Officer Joshua Krueger was at Fireside Apartments on Main Street in response to a complaint that one of the residents was selling drugs.

He went to Sommer's apartment where he spoke with Sommer and a 13-year-old boy.

According to the criminal complaint, Krueger found a plastic medication bottle on a shelf beneath a light fixture. The bottle was packed with dirt where a small pot plant was growing. Sommer reportedly denied that the plant was his.

Krueger also questioned the boy, who said Sommer had been smoking pot earlier, and he showed Krueger a 16-ounce soda can with holes punched in it and burn marks. Sommer allegedly smoked pot with the boy.

Because Sommer's apartment overlooks Riverview Park, he faces increased penalties if convicted of distributing marijuana to a minor.

While I'm all for throwing away the key on drug dealers, this would be a misapplication of the law.

  5. Percentile,

The law reads that possession of illegal drugs within so many feet of a park is an enhancer of the possession charge. I'm no attorney, but it seems the law was applied correctly.

    Truth,

I agree with you 100%. I'm sick and tired of the cops taking illegal drugs off the streets. -Sarcasm button off-

  9. living healthy,

You have to find humor in those that defend their drug use by posting comments that make you think they are almost illiterate.
