Charges filed for 2013 incident in Waupaca

Theodore J. Mccallister, 45, Phillips, is charged in Waupaca County with first-degree sexual assault of a child.

He is charged as a repeat offender due to prior child sex offenses.

On Feb. 22, 2018, Oshkosh police contacted Waupaca Police Capt. John Helgeson about a sexual assault that allegedly occurred at the Best Western on Grand Seasons in 2013.

According to the criminal complaint, a girl told Winnebago County child protective services that Mccallister sexually assaulted her when she was 7 years old.

She reportedly said Mccallister touched her inappropriately multiple times while she was taking a bath.

He also allegedly threatened to hurt her if she told anyone.

Mccallister faces up to 60 years in prison if convicted of first-degree sexual assault of a child.

On Feb. 23, 1995, Mccallister was convicted of four counts of second-degree sexual assault of a child in Waupaca County.

Then-Judge John Hoffmann sentenced Mccallister to five years in state prison.

On Oct. 10, 2002, he was released, and then returned to prison on June 6, 2003, for parole violations.

On April 20, 2004, he was released again on extended supervision, then returned to prison on June 7, 2004.

On Dec. 5, 2005, he was discharged from prison.

On Sept. 1, 2011, Mccallister was convicted of felon in possession of a firearm. He was placed on six years of probation and sentenced to one year in jail.

On Sept. 23, 2014, Mccallister returned to prison after his probation was revoked for violating the terms of the sex registry.

On Feb. 21, 2017, Mccallister was released on extended supervision.

He is currently in custody following his arrest in Rusk County.
