WAUPACA — A Green Bay man faces up to 100 years in prison after a forensic interview with his teenage son revealed a yearslong pattern of severe sexual abuse that occurred during weekend custody visits at a Waupaca County apartment, according to a criminal complaint filed in Waupaca County Circuit Court.
Enrique J. Tovar, 34, is charged with repeated sexual assault of a child, a Class B felony, and incest, a Class C felony. The charges follow a collaborative investigation by child welfare workers and the Waupaca County Sheriff’s Office.
Authorities allege the assaults occurred approximately between Jan. 1, 2019, and Oct. 28, 2023, in the Town of Lind, spanning a timeframe when the victim was in the fifth through eighth grades.
The investigation began on Monday, April 21, 2026, when Outagamie County Child Protective Services intake worker contacted Waupaca County Sheriff’s Detective Sergeant Alec Brockman. The intake worker reported receiving information that Tovar had sexually assaulted his son, identified in court documents as Child 1, when the boy was in fifth grade.
The abuse reportedly took place at Tovar’s former apartment on Den-Ed Road in the township of Lind, located off U.S. Highway 10.
On Monday, April 27, 2026, Brockman and Cernohous attended and monitored the recorded forensic interviews. Child 1 explained that he was at the center to discuss his father molesting him for a number of years. He stated that his parents split custody, and he generally spent weekends at his father’s apartment.
Child 1 stated that all of the assaults occurred during the evening hours with the bedroom lights turned off, and took place exclusively on nights when he was positioned on the framed bed closest to the wall. On the nights when Child 2 slept in the main bed, no abuse occurred. Child 1 believed his younger brother remained asleep throughout the incidents and did not witness them.
Child 1 testified of sexual abuse that is too graphic and horrific to describe in this newspaper.
Child 1 stated that the last incident occurred during the summer after his eighth-grade year. The abuse ended abruptly following a severe verbal argument between Tovar and Child 1.
According to the complaint, Tovar had searched a cabin belonging to Child 1 and his mother, discovered her prenatal vitamins, and concluded she was pregnant. Tovar reportedly became infuriated, leveled slurs at his son, and left for a local bar.
Later that night, Tovar repeatedly called the mother’s phone, stating that he had destroyed all of Child 1’s belongings, threatening that the boy would never see his dog alive again, and declaring that he was disowning his son. Child 1 stated he never saw his father again after that argument.
The disclosure to law enforcement occurred after Child 1 recently called Tovar a pedophile during a conversation. When his mother confronted him about the statement, Child 1 revealed that he had been molested for years.
Child 1 expressed deep concern for his younger brother, Child 2, who has autism. Child 1 noted that Child 2 had recently returned from visits with Tovar asking unusual questions about bodies and sexual fluids, making Child 1 fear that the abuse might target his brother. Child 2 was also forensically interviewed by authorities, but child welfare workers determined no information of evidentiary value was disclosed.
